Digital Millennium Copyright Act Compliance

Copyright Policy

NicheVolt respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website that are reported to our Designated Copyright Agent.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written notice containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notification.
  2. Identification of the infringing material and information reasonably sufficient to permit us to locate the material on our Site (e.g., URL of the page containing the material).
  3. Your contact information: full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature (typing your full legal name is sufficient for electronic signature).

Fair Use

Some content on NicheVolt may use copyrighted material under the doctrine of "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. We believe this constitutes fair use under Section 107 of the U.S. Copyright Act.

Counter-Notice

If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Your counter-notice must include:

  • Identification of the material that has been removed or disabled and its former location
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district
  • Your physical or electronic signature

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, NicheVolt has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Site and/or terminate accounts of users who infringe any intellectual property rights of others, whether or not there is repeat infringement.
